You were informed about a sampling (NMN - purity> 95%, nicotinamide mononucleotide) by the LGL in a letter dated October 12th, 2020.
The report of the LGL from 11.11.2020 regarding the product, NMN - purity> 95%, nicotinamide mononucleotide, etc. the following can be seen:
I. "Due to the intended purpose of the entrepreneur for oral or sublingual ingestion of the product, the present sample is to be considered a food within the meaning of Article 2 of Regulation (EC) 178/2002 to be assessed.
According to § 1 Abs. 1 NemV a food supplement in the sense of this regulation is a food that
1. is intended to supplement the general diet,
2. is a concentrate of nutrients or other substances with nutritional or physiological effects alone or in combination and
3. is placed on the market in dosed form, in particular in the form of capsules, troches, tablets, pills and other similar dosage forms, powder bags, liquid ampoules, bottles with dropper inserts and similar dosage forms of liquids and powders for absorption in small measured quantities.
The sample is therefore to be considered a dietary supplement in the sense of To be assessed according to § 1 Paragraph 1 NemV. "
II. “Currently,“ nicotinamide mononucleotide ”can be found in the Union list for approved novel foods according to Art. 6 Para. 1 Regulation (EU) 2015/2283 i. V. m. Art. 8 Regulation (EU) 2015/2283 does not find any corresponding entries.
According to Art. 6 (2) of Regulation (EU) 2015/2283, only novel foods that are approved and listed in the Union list may be placed on the market as such or used in and on foods in accordance with the conditions and labeling regulations specified in the Union list.
We therefore assume that the present sample "NMN - purity> 98%, nicotinamide mononucleotide" is a new type of food within the meaning of Art. 3 Paragraph 2 Letter a) Number i) Regulation (EU) 2015/2283 , which does not correspond to Art. 6 Para. 2 Regulation (EU) 2015/2283. "

Since, based on the expert opinion, it is a new type of food within the meaning of Article 3 Paragraph 2 Letter a) Number i) Regulation (EU) 2015/2283, which does not correspond to Article 6 Paragraph 2 Regulation (EU) 2015/2283 , this product is NMN - purity> 98%, nicotinamide mononucleotide not marketable.
Please confirm that you will immediately remove this product (s), NMN - purity> 98%, nicotinamide mononucleotide (any container with different weights and capsules) from your sale (various online shops, including Amazon) and these No longer offer products.
We also ask you to name any resellers and to inform them.
We expect the confirmation and any resellers by December 18, 2020 at the latest.
